Terms of Service

1. Agreement

By accessing or using FusionTest (the “Service”) operated by FusionLeap Digital (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Use of the Service

You may use FusionTest for lawful purposes only. You are responsible for all activity under your account. You must not:

• Use the Service to test applications you do not own or have authorisation to test.
• Attempt to reverse-engineer, decompile, or extract proprietary models or algorithms.
• Resell or sublicense access to the Service without our written consent.
• Use the Service in any way that violates applicable law.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your API keys and login credentials. Notify us immediately at support@fusionleap.io if you believe your account has been compromised.

4. Beta, Fees & Limits

FusionTest is in beta and is free to use. Each organization has usage limits, currently on runs started from the dashboard and on team members; runs from the CLI with your own AI provider keys are not limited by us. We may change these limits. We will introduce paid plans only with at least 30 days' notice, and you will never be charged unless you choose a paid plan. Because the Service is in beta, features may change, and some may be added or removed.

5. Intellectual Property

FusionLeap Digital retains all rights to the Service, including its underlying models, algorithms, and infrastructure. You retain ownership of your test goals, run reports, and any data you upload. By using the Service, you grant us a limited licence to process your data solely to provide the Service.

6. Data & Training

To run tests, FusionTest sends page structure, goals and actions to third-party AI model providers, as described in our Privacy Policy. We do not use your data to train AI models. If we ever want to, it will be opt-in only, using anonymised data, and we will tell you in advance. We never share identifiable data with third parties for training purposes.

7. Availability

During the beta we work to keep the Service available but make no uptime commitment and offer no service-level agreement. Current status is shown on the status page in the dashboard. The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted or error-free, or that test results will be complete or correct.

8. Limitation of Liability

To the fullest extent permitted by law, FusionLeap Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim.

9. Termination

You may close your account at any time by emailing support@fusionleap.io; we delete your data as described in our Privacy Policy. We may suspend or terminate your account for breach of these Terms with or without notice. Upon termination, your access to the Service ends immediately.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which FusionLeap Digital is registered. Disputes will be resolved by binding arbitration unless you opt out within 30 days of account creation by emailing support@fusionleap.io.

11. Changes

We may update these Terms at any time. Material changes will be communicated by email or an in-app notice at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.
